You’ve likely been following the biggest story of the weekend, on President Trump pressing into service the Alien Enemies Act from 1798 to remove known criminals, many of whom are members of Venezuela’s violent Tren de Aragua crime syndicate, from the country.
The move was anticipated early on Saturday, so progressives started things in motion even before the president’s action. Chief U.S. District Judge James Boasberg issued an order preemtively blocking the administration’s use of the law; my colleague Streiff picks up the chain of events from late Saturday:
A DC judge ordered the Trump administration to turn around flights deporting known members of the Venezuelan-based designated Foreign Terrorist Organization Tren de Aragua and return them to the US after he entered a temporary restraining order on the part of five gang members and created a “class” of similarly situated criminals; see Activist Nation: Judge Orders Plane Carrying Gangsters Kicked Out by Trump to Turn Around.
The planes, headed for a third-party country for detainment, El Salvador, did not turn around. My colleague Bob Hoge wrote Sunday on the reasons why the U.S. went ahead with the flights sending away the gangbangers; Hoge also dropped in a powerful video–the world was able to see what all happened, thanks to a major assist from President Nayib Bukele, who also mocked the judge in his X post. Now, White House Press Secretary Karoline Leavitt has commented on criticism of the administration’s move as refusing to comply with a court order.
She said in a statement:
“The Administration did not ‘refuse to comply’ with a court order. The order, which had no lawful basis, was issued after terrorist TdA aliens had already been removed from U.S. territory. The written order and the Administration’s actions do not conflict. Moreover, as the Supreme Court has repeatedly made clear — federal courts generally have no jurisdiction over the President’s conduct of foreign affairs, his authorities under the Alien Enemies Act, and his core Article II powers to remove foreign alien terrorists from U.S. soil and repel a declared invasion.”
The PressSec continued, blasting Judge Boasberg’s attempted lawfare:
“A single judge in a single city cannot direct the movements of an aircraft carrier full of foreign alien terrorists who were physically expelled from U.S. soil.”
