As nursery managers, ensuring compliance with early years ratios within the EYFS framework is essential for delivering high-quality childcare while safeguarding the welfare, safety, and development of the children in your early years setting. With changes to the EYFS Framework regulations now in place, staying informed and organised is more important than ever. What Are Early Years Ratios?

Early years ratios dictate the minimum number of qualified staff required to care for a specific number of children in early years settings. These ratios are defined by the Department for Education (DfE) in the EYFS Statutory Framework.

Key Changes for early years settings, effective September 2023

  • Two-Year-Olds: The ratio for two-year-olds changed from 1:4 to 1:5.
  • Supervision During Meals: “Adequate supervision” now requires children to be within sight and hearing of an adult while eating.

While these changes aim to offer more flexibility, they also require careful management to ensure compliance without compromising quality.

 

Understanding Ratios In Early Years Settings

Ratios apply across the entire nursery, not just individual rooms. For instance:

  • Under 2s: 1 qualified member of staff per 3 children.
  • 2-Year-Olds: 1 qualified member of staff per 5 children.
  • 3+ Years: 1:13 if a Level 6 qualified practitioner (e.g., EYTS, EYPS, or QTS) is working directly with children; otherwise, the ratio remains 1:8.

These ratios are not optional minimums. They represent the legal baseline, though you can choose to maintain stricter ratios to enhance quality.

Qualifications and Competency

To be counted in early years ratios, staff must hold qualifications recognised as full and relevant by the DfE. However, there are exceptions for:

  • Suitable students on long-term placements.
  • Volunteers aged 17 or over.
  • Apprentices aged 16 or over working in early education.

Managers must ensure that all staff included in ratios are competent and responsible. Additionally, since January 2024, newly appointed EYFS setting managers must hold or achieve a Level 2 Maths qualification within two years of their appointment.

The updated regulations bring opportunities but also challenges:

  1. Flexibility with Two-Year-Olds: Adjusting staff levels to accommodate the new 1:5 ratio can help reduce staffing costs, but it requires meticulous planning.
  2. Supervision Standards: Maintaining adequate supervision, especially during meals, demands careful scheduling and clear communication.
  3. Qualification Tracking: Ensuring all staff qualifications meet requirements, particularly for new managers, adds another layer of complexity.
