Keep an Eye on This: More Lefty Judges Are 'Unretiring' in Preemptive Strike Against Trump's Agenda

Every day that we get closer to Donald Trump’s second inauguration, you can feel the left’s desperation as their political winter sets in. They have a laundry list of radical things they’d like to see happen before the moving vans haul Joe Biden’s things out of the White House, and time is running out.





One of the cudgels Democrats are signaling they intend to wield against the new Trump administration is the judicial branch of the government. Come January, they won’t control the executive branch or the legislative branch, so they’re left with figuring out how to shore up their power in the only branch left: the judiciary.

Right on cue, here come the “unretirements” by Democrat-appointed or anti-Trump activist judges who had already announced their retirements and had one foot, and in some cases two, out the door.

RedState’s resident legal eagle, Susie Moore, reported on this phenomenon earlier this month.

Politicians are notorious for flip-flopping, typically in whichever direction is most politically expedient for them. Judges generally are not.

Yet, two federal judges have done an about-face on their plans to retire — and Senate Minority Leader Mitch McConnell (R-KY) is none too pleased about it. 

The Senate GOP leader on Monday slammed decisions by two federal judges to reverse their announced retirements after Republican former President Trump won re-election in November.

Minority Leader Mitch McConnell, R-Ky., criticized the pair of “partisan Democrat district judges” after they announced plans to “unretire” after “the American people voted to fire Democrats last month.” 

“Looking to history, only two judges have ever unretired after a presidential election. One Democrat in 2004 and one Republican in 2009. But now, in just a matter of weeks, Democrats have already met that all-time record. It’s hard to conclude that this is anything other than open partisanship,” McConnell said in remarks delivered on the Senate floor.





McConnell, as Susie reported, was irked at the decisions of Ohio U.S. District Court Judge Algenon Marbley and North Carolina U.S. District Judge Max Cogburn to reverse course on their already-announced plans to take senior status, which created two circuit court vacancies for Trump to fill.

And McConnell was justified in his anger due to the fact that Senate Democrats had agreed to let Trump fill several circuit court vacancies.

The latest judge to “unretire” and snatch a vacancy from the president-elect is a Barack Obama appointee, U.S. Circuit Judge James Wynn, 70, of the Fourth U.S. Circuit Court of Appeals. Wynn informed President Joe Biden on Friday that he was reversing course, writing, “I apologize for any inconvenience I may have caused.”

Senator Thom Tillis (R-NC), whose state is within Judge Wynn’s jurisdiction, called foul:

“Judge Wynn’s brazenly partisan decision to rescind his retirement is an unprecedented move that demonstrates some judges are nothing more than politicians in robes. Judge Wynn clearly takes issue with the fact that Donald Trump was just elected President, and this decision is a slap in the face to the U.S. Senate, which came to a bipartisan agreement to hold off on confirming his replacement until the next Congress is sworn-in in January.”





Following Wynn’s announcement, The Article III Project, a conservative advocacy group run by Trump ally Mike Davis, said it intended to file judicial misconduct complaints against Judges Marbley and Cogburn for rescinding their retirements after Donald Trump’s November 5th win.

Once is happenstance. Twice is a coincidence. Three times is a pattern. The Democrat Party and their minions are desperate; be on the lookout for more attempts to hijack the judicial branch ahead of Inauguration Day.
