It seems we’ve been waiting all week for a signal from Judge Juan Merchan as to what he intends to do regarding post-trial motions filed by President-elect Donald Trump’s legal team and the sentencing, which was set for November 26. We now have our answer — in part.

In an order issued Friday morning, Merchan granted Trump’s motion for leave to file a motion to dismiss pursuant to the Constitution, the Presidential Transition Act of 1963, and the interests of justice in light of Trump’s being reelected to the presidency.

Merchan gave Trump’s legal team until December 2 to file their motion and District Attorney Alvin Bragg’s office until December 9 to file their response. He also agreed to delay ruling on the presidential immunity issue. And last but not least, he adjourned the November 26 sentencing date.

So now we wait a bit longer to see how this all shakes out. December 2 will be a big day for Trump in the courts as that is also the day filings are due in the federal courts regarding the two criminal cases brought by Special Counsel Jack Smith and what the DOJ plans to do with them in light of Trump’s election.

RedState will, of course, continue to follow all of the legal developments and provide updates on them as they become available.
